Bengal post-poll violence: CBI to probe murder and rape cases, HC says

The Calcutta high court on Thursday ordered court-monitored CBI probe into alleged into murder, rape cases during post-poll violence in West Bengal and asked the central agency to file report by six weeks.


The high court has also ordered to set up SIT for investigation into other offences. Senior officers from West Bengal cadre will be a part of the special investigation team.

The state government has been asked to hand over all documents and records to the investigating agencies. "In case, the state is not acting properly, it will be viewed seriously," the high court stated.

Union minister Anurag Thakur welcomed the court's decision and and affirmed there is no place for violence in democracy.

"We welcome the court's decision. In a democracy, everyone has the right to spread their ideology but one is allowed to spread violence. There is no place for violence in democracy," Union minister Anurag Thakur said.

Meanwhile, TMC's Saugata Roy said he is unhappy with the verdict and the state government will take a decision to appeal to a higher court if necessary.

"I am unhappy with verdict. If in every law and order matter which is entirely within state government's jurisdiction the CBI comes in it is transgression on state's right. I am sure state government will judge the situation and take a decision to appeal to a higher court if necessary," Saugata Roy said.

The order came in response to a set of PILs seeking impartial probe into alleged post-poll violence in West Bengal.

The PILs alleged that people were subjected to assault, made to flee homes and their properties were destroyed as a result of post-poll violence in West Bengal and sought an impartial probe into these and protection of life and liberty.

The high court had ordered the NHRC to constitute an inquiry committee to probe various accusations during the "post-poll violence".

In its report, the NHRC panel recommended a CBI probe into the "grievous offences like murder and rape" which allegedly took place during the post-poll violence and said the trial should be held outside the state.

The report strongly criticised the Mamata Banerjee-led state government for allegedly failing to stem the political violence that erupted after the Trinamool Congress's victory in the assembly elections.
